Welcome to Gymner LLC. (“Company”, “we”, “our”, “us”)! As you have just clicked our Terms of Service, please pause, grab a cup of coffee and carefully read the following pages. It will take you approximately 20 minutes.

These Terms of Service (“Terms”, “Terms of Service”) govern your use of our mobile application Gymner operated by Gymner LLC.

Your agreement with us includes these Terms (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service. Thank you for being responsible.

2. Use and Restrictions

Gymner offers various functionalities, including the creation of workout routines, individual exercises, and meal plans. The App is intended for personal use only and should not be used for any illegal activities. Users are responsible for the accuracy and legality of the data entered into the App. Users must comply with all applicable laws and regulations while using the App. By using the app, you agree to use it solely for personal and non-commercial purposes.

3. Health and Medical disclaimer

Any advice found in the Application or in the Gymner website of any kind such as how to perform an exercise involving or not physical activity is for information purpose only. Nothing written inside the Application is medical advice. Nothing in the Application is meant to diagnose, treat, prevent or cure any disease or injury.

You expressly agree that any activity performed or tracked using Gymner carry inherent risks of injury or death and You assume all known and unknown risks associated with any activity even if caused in whole or part by the action, inaction or negligence of Gymner or others, including other Gymner users.

Gymner shall not be held liable for any damages, indirect or direct, related to or resulting from any use of the services, including injury or death. By using this Service we recommend that you consult with your doctor before performing any physical activity, and you consult a professional in how to perform any exercise that involves physical activity before performing such physical activity.

4. Purchases and Payments

Gymner offers in-app purchases, a lifetime license to access premium features. All purchases are managed through the Apple App Store. Transactions are subject to the terms and conditions of the App Store.

5. Refund Policy

Since in-app purchases are managed by the App Store, any refund requests must be made through the App Store in accordance with their refund policies.

6. User-Generated Content

Users can create and manage their own workout routines, exercises, and meal plans. You are responsible for the content you create and share through Gymner. You must not upload, share, or distribute illegal, offensive, or infringing content.

7. Intellectual Property

All rights, titles, and interests in and to the app, including all intellectual property rights, belong to Gymner, LLC. You are not granted any license or right of use except as necessary to use the app in accordance with these Terms and Conditions.

8. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

9. Modifications to the Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Modifications will be effective immediately upon posting in the app. Your continued use of the app after any modifications constitutes your acceptance of the new terms.
